A structured settlement is defined as an agreement between two parties, typically between an insurance company and a private individual, or business or another insurance company, where one insurance company will be making monthly or yearly payments(annuities) to the other party over a specified period of time. It is the result of a judgment in favor of one party reached within or outside of court, due to an accident, malpractice, or any other negligence caused by the other party. The damages are usually funded in the form of an annuity contract issued by an insurance company. Structured settlement annuities differ from other types of annuity payments in that structured settlement payments are not subject to income tax. While the payments are guaranteed to the plaintiff, for tax purposes the policy is usually assigned to an affiliate of the insurance company making the payments.
